The services of the Teamish application are provided by the legal entity Teamish Ltda, registered with the CNPJ under number 49.232.053/0001-27, holder of the intellectual property rights over the software, website, applications, contents and other assets related to the platform.
The platform aims to license the use of its software, website, applications and other intellectual property assets, providing tools to assist and streamline the daily activities of its users and teams.
Teamish is a networked gamification application that was born out of the need to motivate teams. We believe that daily life, whether at work, school or with family, can become a more enjoyable journey through an innovative gamified system. To achieve this, we offer a space with motivational missions, peer recognition and the ability to deliver rewards for a job well done. Teamish is designed for groups and companies that want to promote their culture, create engaged teams and retain their talents.
This Term establishes obligations freely and voluntarily contracted for an indefinite period of time between the Teamish platform and individuals or legal entities, users of the application.
By using the platform, the user fully accepts these rules and agrees to observe them, under the risk of applicable penalties being applied.
Acceptance of this agreement is essential for access and use of any services provided by the company. If the user does not agree with the provisions of this agreement, they should not use them.
All technical solutions available to the platform manager will be used to enable access to the service 24 (twenty-four) hours a day, 7 (seven) days a week. However, browsing on the platform or any of its pages may be interrupted, limited or suspended for updates, modifications or any action necessary for its proper functioning, except in cases of fortuitous events or force majeure.
Access to the features of the Teamish platform requires prior registration and, upon registering, the user must provide complete, up-to-date and valid information. It is the user's sole responsibility to keep such data updated, as well as to ensure the accuracy of the information provided.
The user agrees not to disclose their registration data and/or platform access to third parties, fully responsible for any use made of them.
Individuals under 18 years of age and those who do not have full legal capacity must obtain express consent from their legal guardians prior to using the platform and its services or products. It is the sole responsibility of legal guardians to ensure that minors and those who do not have full legal capacity do not access the platform without prior authorization.
By registering, the user declares and expressly guarantees to be fully capable, able to exercise and freely enjoy the services and products.
The user must provide a valid email address through which the website will carry out all necessary communications.
After confirming the registration, the user will have a personal login and password, which ensures individual access. Therefore, it is the user's sole responsibility to maintain said password confidentially and securely, avoiding unauthorized access to personal information.
Any and all activity carried out using the password will be the responsibility of the user, who must promptly inform the platform in case of improper use of the respective password.
It will not be allowed to assign, sell, rent or transfer, in any way, the account, which is personal and non-transferable.
It is the user's responsibility to ensure that their equipment is compatible with the technical characteristics that enable the use of the platform and its services or products.
The user may, at any time, request the cancellation of their registration with the Teamish application. Their deregistration will be carried out as quickly as possible.
By accepting the Terms and Privacy Policy, the user expressly authorizes the platform to collect, use, store, process, transfer or utilize the information derived from the use of the services, the website and any platforms, including all information provided by the user at the time of registration or update, as well as others expressly described in the Privacy Policy, which must be authorized by the user.
In case of doubt, suggestion or problem with the use of the platform, the user can contact support via email at help@teamish.app.
It is the user's responsibility to:
a) be liable for any and all (judicial or extrajudicial) actions, claims, damages, losses, liabilities, expenses, and legal fees that Teamish may suffer or incur as a result of or in connection with the violation of any obligation set forth in these General Terms and Conditions of Use.
b) the proper use of the platform, services or products offered, valuing good interaction, respect, and cordiality among users.
c) by complying with and respecting the set of rules set forth in these General Terms and Conditions of Use, in the respective Privacy Policy, and in national and international legislation.
d) for any and all content uploaded, sent, and/or transmitted to Teamish.
e) for protecting the access data to their account/profile (login and password).
It is the responsibility of the Teamish platform to:
a) indicate the characteristics of the service or product;
b) the defects and flaws found in the service or product offered, provided that they are caused by the provider.
c) The information that was disclosed by him, considering that the comments or information disclosed by users are the sole responsibility of the users themselves.
The platform is not responsible for external links contained in its system that may redirect the user to an environment outside its network.
External links or pages that serve commercial or advertising purposes or any illegal, violent, controversial, pornographic, xenophobic, discriminatory, or offensive information cannot be included.
This Terms of Use grants users a non-exclusive, non-transferable, and non-sublicensable license to access and use the platform and the services and products made available by it.
The structure of the website or application, trademarks, logos, trade names, layouts, graphics and interface design, images, illustrations, photographs, presentations, videos, written and audio content, computer programs, databases, transmission files, and any other information and intellectual property rights of the company Teamish, subject to the terms of the Industrial Property Law (Law No. 9.279/96), Copyright Law (Law No. 9.610/98), and Software Law (Law No. 9.609/98), are duly reserved.
This Terms of Use does not assign or transfer any right to the user, so that the access does not generate any intellectual property right to the user, except for the limited license granted herein.
The use of the platform by the user is personal, individual, and non-transferable, and any unauthorized use, whether commercial or non-commercial, is prohibited. Such uses will constitute a violation of the intellectual property rights of the company Teamish, punishable under the applicable legislation.
Without prejudice to other applicable legal measures, the corporate name Teamish may, at any time, warn, suspend or cancel the user's account:
a) that violates any provision of these Terms;
b) who fails to comply with his duties as a user;
c) that has any fraudulent, malicious or offending behavior to third parties.
Failure to comply with the obligations stipulated in this Terms of Use or applicable legislation may, without prior notice, result in immediate unilateral termination by the company Teamish and the blocking of all services provided to the user.
The items described in this instrument may be unilaterally and at any time changed by Teamish in order to adapt or modify the services, as well as to comply with new legal requirements. The changes will be made available through the Teamish application and the user may choose to accept the new content or cancel the use of the services.
In addition to this Agreement, the user must agree to the provisions contained in the respective Privacy Policy to be presented to all interested parties within the platform interface.
Brazilian law shall be fully applied to the solution of disputes arising from this instrument.
Any disputes shall be submitted to the jurisdiction of the court of Belo Horizonte, State of Minas Gerais.
